Trump administration targets Ivy League schools, Racial Discrimination Law Magazine

The Trump administration investigated Harvard and Harvard legal reviews after accusing the journal of discriminating against readers, who wanted to respond to articles about police reform because they were white.

Both the Ministry of Education and the Ministry of Health and Human Services (HHS) have committed possible violations of Chapter VI of the Civil Rights Act of 1964.

The investigation was initiated in response to information, and both federal agencies received policies and practices regarding journal membership and article selections that could violate Title VI.

HHS reportedly claimed in a press release that the editor of the Harvard Law Review reportedly involved “four out of five” who wanted to answer the “white” of articles about police reform.

HHS also said another editor in the comments suggested: “Since the authors are a minority, a quick review of an article should be done.”

Chapter VI of the Civil Rights Act of 1964 prohibits race, color and nationality based on education programs and activities based on federal funding. Any violation of Chapter 6 could result in the federal government losing funds.

"The article selection process of Harvard Law Review appears to be a race-based selection of winners and losers, where the trophy system is adopted, where the race of legal scholars is more important than the merits submitted," said HHS agent Craig Trainor. "The requirement of Title VI is clear: Recipients of federal financial aid may not be distinguished based on race, color, or nationality. No institution (regardless of its ancestry, reputation, or wealth) is beyond the law. The Trump administration will not allow Harvard or any other federal funding to trample on anyone's civil rights."

"Harvard Law School is committed to ensuring that the programs and activities it oversees comply with all applicable laws and investigate any credible alleged violations. Harvard Law Review is a legally independent student of the law school, which the organization dismissed with the U.S. District Court (Massachusets in School).

The investigation was as the Trump administration continued to argue with elite educational institutions, announcing earlier this month that it would cut more than $2.2 billion in funding to Harvard University, while threatening another $1 billion in federal grants and funding.

After Harvard refused to comply with a series of requests from the Trump administration to conduct various actions on campus, the administration revealed that on April 18, it would freeze more than $2 billion in federal funds.

Harvard President Alan M. Garber said in a statement that President Donald Trump's administration has made other demands that not only address anti-Semitism on campus, but that the institution does not comply because the demands are unconstitutional.

Garber said the new requirement “directly regulates the state of intelligence at Harvard”, including audit views of students, faculty and staff on campus and eliminates all diversity, equity and inclusion (DEI) programs, offices and initiatives at Harvard.

"It is obvious that the intention is not to work with us to resolve anti-Semitism in a cooperative and constructive way," Garber wrote. "We have informed the government through legal counsel that we will not accept the agreement they proposed."

The Trump administration set up a federal task force in February to combat anti-Semitism, aiming to eliminate bias on campuses that have been targeting Jewish students since October 2023.

"It's time for elite universities to take the issue seriously and commit to meaningful changes if they want to continue to get taxpayers' support," the task force said in a statement.
