Trump administration must maintain custody of immigrants deported to South Sudan

President Donald Trump's administration must maintain custody of illegal immigrants in South Sudan, a federal judge ruled

U.S. District Court Judge Brian Murphy of Massachusetts issued a ruling Tuesday night after an illegal immigration lawyer in Myanmar and Vietnam accused the Trump administration of illegally deporting its clients to third-party countries. They believe there is currently a court order to prevent such evacuations.

Murphy's ruling said the government must "maintain custody and control of class members currently being handed over to South Sudan or any other third country to ensure that the court considers such evacuation illegal if the court considers the court's practical feasibility."

Immigration lawyers believe that deportation violates court orders, requiring immigrants to be granted “meaningful opportunities” to determine that sending them to a third country would make them unsafe.

Murphy, appointed by President Joe Biden, has previously discovered that any plan to expel people to Libya would be "obviously" "obviously" in violation of his ruling, which also applies to those who otherwise deplete legal appeals.

Murphy said in his Tuesday order that U.S. officials must appear on Wednesday to determine affected immigrants, address when and how to learn that they will be removed from their posts to a third country and what opportunities they have to file a fear-based claim. He also ruled that the government must provide information on the whereabouts of immigrants who have obviously been removed.
