The man allegedly raped by Gareth Ward asked on his route to the NSW MP's home | NSW

A political worker accepted his actions before and after the allegedly invited him to his home for sexual assault.

Kiama MP Gareth Ward, 44, pleaded not guilty to sexual intercourse without consent and indecent assault charges, tried in NSW District Court.

The jury was told that he had contacted a young, drunk political officer and provided him with a overnight accommodation after a midweek event at the NSW Capitol in 2015.

Political staff, who cannot be named, told the jury Thursday that after the event, a taxi home would generate a fare of about $110.

He said he accepted Ward's proposal to stay at his Potts Point apartment, where politicians poured his drink, allegedly trying to kiss him, and then climbed into bed with him.

The complainant, who was 24 and now in his 30s, expressed excitement on Wednesday, while accusing Ward of fumbled on his back and sexually assaulting him, despite repeated saying "no" and trying to move away.

The jury was shown a videotape to the jury, which was a route that the staff followed the route he believed he was walking with Ward during the alleged sexual assault and the next morning.

In the video, he pointed to a building, and he told police that he was "certainly" that it contained Ward's apartment due to the view of Sydney Harbour.

Staff said he remembered walking two different paths when he was heading back and forth, but admitted that he couldn't be precise because he was intoxicated at night.

After cross-examination by Ward barrister David Campbell SC He accepted his way of traveling, rather than thinking of two different routes, he might be confused.

Staff told police in an initial statement in 2021 that he did not remember their arrival at the streets of the apartment, but he said his memories have been recovered and jogged since then.

In the video, he told police he remembered walking back along the steep stairs in the morning while returning to the city with Ward.

The court was told, but the stairs were not mentioned in his initial police statement.

Campbell advised the couple never stopped for coffee, noting that the alleged victim did not mention the details in a 2021 statement to police.

The complainant replied: “For my memories, we did it.”

He also dismissed Campbell's suggestion that he did not walk through the park with Ward, nor talk to him outside of the council, as he had previously testified.

Staff said he believed the sexual assault occurred between July 2015 and September 2015, Campbell noted that it was different from his previous testimony, which he believed was happening in September, but was uncertain.

The complainant said: "That is that I am cautious about your hostile doubts."

He rejected Campbell's suggestion that he should be able to recall "a date of almost a day" because he made detailed descriptions of the incident on the day of the alleged attack.

The staff replied: “Sometimes, memories come together.”

Political workers said Wednesday that he felt "dirty" and "confused" after the incident and asked himself if he had done something to invite unnecessary progress.

Ward was also accused of hesitatingly attacking an 18-year-old child in 2013 after meeting the man at a cyber event on the South Coast of New South Wales a year ago.

The man claimed that the MP stroked his hips and scrotum and gave him an unnecessary back massage despite repeated requests to stop.

Ward, who was accused of alleged assault in 2022, debated with the charges and his attorneys and is expected to address jurors later in the trial.

He has served as a Kiama voter since 2011, winning three elections before receiving a 2023 poll.
