Mike Bookout's recent FreightWaves letter is misleading and full of false statements.
This is a real story:
As many readers know, I have always been investors of MyCarrier, Project44 (P44) and MyCarrier have always paid attention to the innovation of the LTL industry. In fact, since its establishment in 2017, P44's data and products have provided motivation for MyCarrier's platform.
Starting from the first day, P44 licensed its data, API and analysis permits with a large discount, which was far lower than the market value. The reason why we invest in this investment is because we believe in partnerships and the potential of digital LTL transportation. Over the years, MyCarrier has been one of the largest users of P44. It has seriously relied on our technology, including Ebol, and P44 was launched in 2019.
By 2023, as the original discount price of the original contract expired, P44 clearly stated that MyCarrier had two options:
A friendly manner is integrated into a part, even if P44 can even help MyCarrier build its own operator integration.
Sign a new five -year contract and gradually increase the same as the market price over time.
MyCarrier chose to leave and sign a new five -year contract in October 2023. The agreement includes the standard "no construction" and non-competitive clauses-MyCarrier agreed without reservation, and there are similar clauses in the 2017 agreement.
At that time, MyCarrier guaranteed that P44 had no intention of competition, and only sought limited, non -competitive connectivity. However, the documents obtained by the court's order tell a different story.
When negotiating a new contract, MyCarrier has plans to violate the contract.
A few days before signing the contract, MyCarrier hired API experts and hired a team in Serbia to establish alternatives for the P44 platform.
The internal MyCarrier file shows that the company's CTO estimates that their "proxy system" has been completed for 18 months. It proves that this is the premeditated effort to gradually eliminate P44 when we are still using our service.
At the end of 2023 and at the beginning of 2024, MyCarrier demanded a customized Ebool change. Due to the priority of resources, the P44 did not implement them immediately, but by 2024, these changes have been enabled.
Nevertheless, MyCarrier started its own Ebole system, even if:
The Ebool and the P44 contract are incorporated into Ebool, and they are still using P44 to send thousands of doctors per day.
Project44 is still the world's largest Eboor provider. In June 2024, it can handle 99,000 Eboles that meet NMFTA, far more than any competitor.
In April 2024, P44 launched Eboles, which is in line with NMFTA, and continued to invest in specific enhanced functions of operators.
The fact is that because of the lack of P44's Eboor service, MyCarrier did not develop its own Ebool. The reason for this is because although the contract clearly prohibits this contract, Ebool is the simplest first step in the larger plan of P44.
When P44 officially notified MyCarrier in June 2024, MyCarrier initially promised "hard work".
instead:
In July 2024, MyCarrier proposed a temporary restriction order (TRO) to P44, which mistakenly claimed that we threatened to suspend services.
After the court approved P44's evidence hearing and requests, MyCarrier failed to successfully abandon the court's lawsuit and help private arbitration, which clearly shows that their own evidence is problematic.
In September 2024, without notification, MyCarrier suddenly cut off the relationship with P44 and transferred to a competitor to a competitor. This was another violation of the contract.
This is not just contract disputes. This is the integrity of trust, fair business practice and industry partnership.
The agreement between P44 and MyCarrier clearly prohibits them from developing independent APIs, products and services that are basically similar to P44 products. The agreement also prohibits MYCARRier from competing with Project44, which is obviously carried out by new data providers. MyCarrier also abuses the data obtained through P44 to violate the contract to analyze the power supply.
Despite many warnings, MyCarrier continued these illegal acts, threatening serious competition damage to P44 and destroying the LTL industry. This is why P44 requires the court to stop MyCarrier from further violations and prevent continuing to use alternative service providers.
I have made in -depth investment in the LTL industry throughout my career. This industry is based on relations, trust and long -term collaboration. That's why I personally tried to solve the problem with mycarrier's leadership in private, including Mike Bookout, members of the board of directors and other stakeholders, before taking legal lawsuits.
Unfortunately, MyCarrier made it clear that they had no intention of fulfilling their promises.
Project44 did not launch this controversy, but when MyCarrier destroyed the contract, abused our technology and deceived the industry, we would not stand it. We are committed to protecting customers, partners and LTL ecosystems. Hearing and P44 court demonstration materials can be found here.
