Watch: Rubiales says he agrees to World Cup kiss

Luis Rubiales told the court he was "absolutely sure" that Spanish footballer Jenni Hermoso agreed before kissing her in the 2023 Women's World Cup final.

The former president of the former Royal Football Federation of Spain (RFEF) is under trial and is charged with sexual assault and attempting to publicly impose Ms Hermoso publicly stated that the kiss was voluntary.

Mr Rubiares, 47, said it was a "action of affection" and added that it was "completely spontaneous".

The incident occurred at a medal ceremony held by Spain after the Australian World Cup championship, sparking protests and calling on Rubiares to resign. He denied any criminal wrongdoing.

Mr Rubiares said on Tuesday in the national court in Madrid in Spain that Hermoso "embraces" him at the ceremony.

"I've known her for many years, and I kissed her because she was the champion. It was a huge moment for her."

"We are champions, we thank each other. She pressed me hard on her waist and I asked her if she could give her a kiss and she said yes."

He added: "I grabbed her so I wouldn't fall."

Mr Rubiares was asked whether he asked Ms. Hermoso to kiss or "small kiss".

He replied, "I don't remember for sure." "But I think it was a little kiss."

Prosecutor Marta Durantiez repeated: "Did you tell her to kiss or kiss on her lips?"

Mr Rubiales replied: "I don't remember that moment, but it's obvious that the kiss I said. There are synonyms."

When asked about his usual kissing someone on his lips, Rubiales told the court that he felt the occasion, and the fact that he knew Hermoso for a long time.

He added that he will be in the New Year celebrations with a male player or one of his daughters.

He was also asked if he knew the protocols against sexual harassment and violence, and he replied that he knew.

A lip reading expert - convened by Rubiares' legal team, calling for testimony. "Can I give you a kiss?" But her reaction was invisible.

Lip reader also admitted that he only analyzed the videos posted on tiktok and could not specify who they belong to.

Rubiales' team also called it the second expert, claiming that the video has not been modified in any way.

According to Spanish media reports, Ms. Hermoso's lawyer asked the lip readers to distinguish the word "Kiss, Peck, pretty or small".

He clarified: "Yes, there will be a difference."

In last week's testimony, Ms Hermoso insisted that she did not allow Mr Rubiales, the incident has "It's stained one of the happiest days of my life".

She had previously told the court: “My boss is kissing me, and this shouldn’t happen in any social or work environment.”

The Spanish striker added: "I only kiss on my lips when I decide."

Ms Hermoso said she was pulled aside shortly after the kiss and asked for agreement to minimize the incident, which she refused to do.

She told the court that Mr Rubiales then asked her to record video with him during the flight because he was accused of assaulting on social media. She said she received a death threat that prompted her to move her family to Mexico where she is playing now.

Mr Rubiales admitted that he had "made a mistake" on the podium and that his behavior was "inappropriate", saying he should "play a more institutional role", but denied that any crime had been committed.

He said the media attention attracted by the incident was "ridiculous", adding that Ms. Hermoso had never condemned his kiss at any time after the incident.

Millions of TV viewers and the entire stadium witnessed the incident after the Spanish women's team won the 2023 World Cup.

The ensuing commotion gave the Spanish women's competition a "I'm Me" style sport in which players try to combat gender discrimination and achieve equality with their male peers.

Mr Rubials resigned in September 2023, after weeks of resisting pressure, after FIFA suspended his investigations with Spanish prosecutors.

Mr Rubiales also denied that he sent someone to talk to Ms Hermoso's family in an attempt to get her to agree to make a video with him to ease public outcry.

Three of his former colleagues are also in a trial accused of colluding in alleged coercion: World Cup winner coach Jorge Vilda, former marketing director Rubén Rivera, formerly Sports Director Albert Luque.

Each of them faces more than a year in prison because Ms. Hermoso allegedly forced to say the kiss was voluntary. All denied the charges.

Prosecutors are seeking two and a half years in prison for Mr Rubiales. The trial lasted until February 19 and continued.
