Family of the suspect in beanie said they tried to warn authorities a few days ago

The man's relatives have been accused of violently attacking a woman in California's luxury home in California's baby billionaire Ty Warner said Wednesday that they repeatedly tried to warn authorities that he might hurt someone in the days leading up to the attack.

Russell Phay's family said in a statement to NBC News that the alleged attacks plunged Linda Malek-Aslanian into a coma two days before his siblings repeatedly called Colorado's state agency, which oversees parole and attempts to issue an alarm. "Over the week we left multiple messages expressing our concerns that Russell could hurt someone in a spiral spiral," the family said in a statement.

They noted that over the years, Phay had experienced severe schizophrenia, which they said had turned him from a kind, loving child to an unstable, sometimes violent and no longer recognizable person.

“Many of us have to distance ourselves from Russell for their own safety, although it has never been easy to do so,” the family said. “Even with our alienation, we tried to act when we saw warning signs of him being in crisis.”

A few weeks before the California attack, the family began to receive worrying calls from Phay. A sibling said in an interview with NBC News that he had no meaning and he did not provide details about where he was.

The siblings said he did not make any specific threats, but the calls prompted family members to contact authorities because they did not want to contact Phay publicly and therefore asked not to agree.

They said they never heard echoes from the Department of Corrections and only learned that Phay was arrested when he called a family member from the prison on May 25 (four days at Werner's home).

The Colorado Department of Corrections did not respond to a request for comment Wednesday.

"This tragedy may be preventable, and we are shocked that the efforts to alert the voice have not been answered yet," the family said.

Court documents and public records show Phay, 42, has a criminal history covering multiple states, including guilty claims for attacks, stalking and threatening. Records show that in Colorado, he was ordered to continue parole two years after being sentenced to 512 days in jail in 2021, the case appears to be one of his latest cases in the state.

It is not clear whether Phay was on parole when allegedly attacked in Santa Barbara, but the siblings said a representative from the state Department of Corrections told the family.

Family members said they were not sure where Phay was when relatives first contacted the authorities. To track him, the family first called officials in Texas and Nevada, and the siblings said Pai had previously committed criminal cases but was told he had not been probation or parole in those states.

The siblings said that while being told he was on parole in Colorado, the family focused on trying to remind the person that he was identified as Phay's parole officer.

Complaints show that one of the recent criminal cases in Colorado appears to be in December 2020, when he was accused of assaulting a baseball bat, public records show. He pleaded guilty to a felony threat in June 2021 and was sentenced to two years in prison the following month, with a 218-day moratorium, court records show.

Authorities have not said why Phay allegedly broke into the home of Warner in Montecito, a wealthy enclave outside Santa Barbara and attacked Malek-Aslanian. Afterwards, Phay allegedly blocked himself in the room and tried to jump out of the second floor bathroom, the sheriff's office said.

Phay was arrested and charged with attempted murder, burglary, kidnapping, assault and other crimes. His attorney declined to comment.

Warner's representative did not respond to a request for comment, nor did he have relatives from Malik Aslanians.

Phay's family said in a statement, "The horrible incident involving our brother Russell M. Phay, and the harm of innocent women who were seriously injured. Our hearts are with her, her family and this ruthless act of violence. We are very sad about the pain and the pain caused by Trauma."

Relatives added that they grieve not only for the victim and her loved ones, but also for the brothers we once knew, and this system continues to fail many families like us.”
