A former police officer's defense team is seeking vital phone records that could shed light on a former police officer's whereabouts when he allegedly killed two men in Sydney.
In February 2024, police discovered the bodies of former TV presenter Jesse Baird, 26, and Qantas stewardess Luke Davies, 29, Beau Lamar- Beau Lamarre-Condon was charged with two counts of murder.
Lamar-Condon's Legal Aid lawyer Alex Curnick told Downing Center District Court on Tuesday she was seeking a so-called Cellebrite report on her client's phone, which refers to software used by police to extract data from the phone.
The data obtained by police in the Cellebrite extraction included location information, internet browsing history, text messages and call logs.
On February 27, the bodies of Baird and Davis were found hidden in a surfboard bag inside a fence at a country estate in Bungonia, near Goulburn, about 200 kilometers southwest of Sydney.
Lamarre-Condon, 29, allegedly shot them with his service-style weapon at Baird's town center home and then attempted to dispose of their bodies.
The court heard police had no objection to turning over Lamar Condon's phone records, but there were still issues with disclosing records related to several other people allegedly involved.
"At the very least, I'm hoping that in the meantime, the Cellebrite on the defendant's phone can ... be made available to us," Curnick said.
District Judge Greg Grogin said the documents should be produced by the court to determine what is allowed to be produced.
"Documents should be produced in court and not withheld," he said. "Let's get some documents that we can provide to the defendant as they become available. Let's move this forward."
