Marietta, Ga. - Mahendra Patel, a 57-year-old Georgia man, was released after six weeks in prison for abduction at Atlanta-Area Walmart.
The Superior Court judge of the Cobb County Judicial Circuit set the bond at $10,000 Tuesday morning. Patel was accused of tearing a 2-year-old Caroline Miller in March. He was charged with a criminal attempt to abduct, assault and assault, according to court documents.
Miller told local TV station WSB-TV Atlanta that she and Patel were “dragged” with their children. But Patel's attorney Ashley Businessman said the surveillance video released in April contradicted Miller's account.
Patel told reporters outside the detention center that he was happy to be custodian.
"I'm a positive person, so you have to take it one day at a time. A lot of ups and downs," Patel said. "But I know we have a team outside to help me. One day, we'll see the light and then we see today."
Miller's 2-year-old was sitting on her lap in a shopping cart for people with disabilities, according to the arrest warrant. Patel allegedly grabbed and pulled the child away from Miller. The arrest warrant says Miller was able to restore control of the child by "wrestling" from Patel.
"This behavior has caused the mother to worry about her and her children's safety," the arrest warrant said.
Interactive surveillance video shows Patel talking to Miller while on the scooter. Miller, who has no disability, said her children love to ride scooters. Once, the 2-year-old slipped from Miller's leg. Patel told law enforcement that he asked Miller where to find Tylenol and tried to help stabilize young children.
"Mr. Patel offered to hold the baby while she stood up to show him where Tylenol was," the businessman said at the hearing. "He fully believed that she was disabled and had two children."
Patel appears to have had a second interaction with Miller, during which time he shows her a bottle of Tylenol he found.
"Mr. Patel went and got Tylenol, the video was not clear," the businessman said at the hearing. "Mr. Patel did not try to kidnap the child."
Since Patel's arrest, he has received support from the entire internet. As of Tuesday, the petition he released had received more than 47,200 signatures.
Patel is still fighting the case, but for now, he says he's happy to have a home cooking meal. No trial date has been arranged.
"I'm picky about food, but I told my daughter and wife and I said, 'I don't care. Better than what I'm going over there.'"
