    A teenage illegal immigrant killed a 24-year-old Colorado woman in a high-speed crash, a leniency lawsuit agreement by a progressive district attorney that allowed him to walk freely without serving his sentence.

    The 15-year-old Columbia teen was publicly named for state laws covering up the identity of a juvenile suspect, and her father, John Weaver, was sentenced to two years of probation and 100 hours of community service in July 2024.

    Alapaho County District Attorney Amy Padden's office would offer a plea agreement to the teen if he acknowledged his guilt in the deadly crash.

    Her father said the teenager rode a jeep with other children at 90 mph in a residential community in Aurora, a Denver suburb, when he pulled the weaver's vehicle at the intersection.

    “This is instantaneous death,” said John Weaver.

    Kaitlyn Weaver waited on the stop sign and spoke to her boyfriend on the speaker when she was hit. She kept her life for two days before being taken away and donated her organs.

    The teenage suspect was arrested and charged with vehicle homicide. John Weaver said at the time, the DA's office told the weaver.

    But in January, Padden was recognized by Senator Bernie Sanders, I-Vt. and Democratic Colorado Governor Jared Polis told the Weaver family that her office will negotiate a probation plea agreement.

    “They said that by doing two years of probation, it may be more than a judge would say guilty,” John Weaver said. “You don't have to join a bad system. If the judge wants to sentence him less, it's the judge's problem. In this case, you (the prosecutor) create it as your problem. Now you are part of the problem.”

    Weaver's attorney Matthew Durkin called the deal “annoying” and noted that the weaver was killed throughout her life.

    John Weaver noted that the teenager who killed his daughter was illegal and unlicensed in the United States.

    “We had a collision, the immigration system and the criminal justice system collided, and now my daughter is dead,” he said.

    According to local reports, the teenager took an uninsured jeep without his mother's permission. His mother told authorities she planned to move him back to Colombia, but he has since applied for asylum.

    Arapaho County Assistant District Attorney Ryan Brackley said he “definitely” condemned the teen’s “reckless and illegal behavior, which was a devastating and irreversible result.”

    “In this case, the belief in the highest allegations and the negotiating judgment acknowledges the seriousness of the preventable tragedy, and there is no legal outcome that can really make up for the huge losses, and Caitlyn's loved ones will live forever,” Brackley said.

    In this week's Facebook post, Padden is committed to Weaver's death while focusing on the dangers of speeding.

    “We acknowledge that Kaitlyn Weaver's death was a direct result of a crash driven by an unauthorized teenager, almost twice the published speed limit,” she wrote. “This tragic loss is a powerful reminder that not only driving with alcohol or drug disorders. Driving at dangerous speeds can also have fatal consequences, but our entire community feels.”
